Welcome to Shaik Corp - SiteForge. These Terms & Conditions (“Terms”) govern your use of our website, products, and services, including website development packages, domain registration, hosting, maintenance, and upgrades. By using our services, you agree to these Terms in full.

1. General

  1.1. SiteForge is a subsidiary of Shaik Corp (Pty) Ltd, South African company providing website development, domain registration, hosting, maintenance, and related digital services.

  1.2. These Terms are in addition to any statutory rights granted to consumers under South African law, including the Consumer Protection Act 68 of 2008 (“CPA”).

  1.3. By purchasing our services, you confirm that you are legally capable of entering into agreements.

2. Website Packages

  2.1. Packages include CoreForge, PowerForge, PrimeForge, and applicable upgrades.

  2.2. SiteForge will deliver the website according to the specifications agreed upon at the point of sale.

  2.3. Clients are responsible for providing accurate content, branding materials, and information.

  2.4. Refunds for website packages are not available once the website is delivered or work has commenced, in line with Section 17 of the CPA on services that have been fully performed.

3. Domain Registration & Transfer

  3.1. Domain names are registered through accredited third-party registries.

  3.2. Once a domain is successfully registered, or a transfer request submitted, registration fees are non-refundable.

  3.3. Clients are responsible for verifying the availability and accuracy of the domain before purchase.

  3.4. SiteForge is not liable for disputes, infringement, or loss arising from domain registration.

4. Hosting & Maintenance

  4.1. Hosting services include ForgeHost and ForgeHost Plus.

  4.2. Maintenance plans include ForgeCare and other add-ons.

  4.3. Customers may cancel services at any time; prorated refunds may be offered at SiteForge’s discretion.

  4.4. SiteForge strives for uninterrupted service but does not guarantee 100% uptime due to technical, network, or external factors.

5. Upgrades & Add-ons

  5.1. Upgrades such as CartForge, ForgeAnalytics, and additional pages are non-refundable once activated.

  5.2. Clients must confirm upgrade requirements before purchase.

6. Client Responsibilities

  6.1. Clients must provide accurate and complete information for all services.

  6.2. Clients are responsible for maintaining the confidentiality of login credentials and account access.

  6.3. Any misuse, fraudulent activity, or illegal use of services may result in account suspension or termination.

7. Intellectual Property

  7.1. All intellectual property created by SiteForge, including templates, code, and content, remains the property of SiteForge until legally transferred through a website package.

  7.2. Clients may not reproduce, sell, or redistribute SiteForge’s proprietary materials without written permission.

8. Liability

  8.1. SiteForge shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue or data.

  8.2. SiteForge’s total liability for any claim shall not exceed the amount paid for the service giving rise to the claim.

  8.3. Nothing in these Terms excludes or limits your rights under South African law, including the CPA.

9. Privacy & Data Protection

  9.1. SiteForge collects personal information necessary to deliver services.

  9.2. We comply with the Protection of Personal Information Act (POPIA) 4 of 2013.

  9.3. Data is processed lawfully, securely, and for the purpose of service delivery, billing, and customer support.

10. Consumer Rights & Cooling-Off Period

  10.1. In accordance with the CPA, you may cancel certain service agreements within 7 days of purchase for services not yet commenced.

  10.2. Services fully performed at your request within this period are not refundable.

11. Payments & Fees

  11.1. All fees are payable in South African Rand (ZAR) unless otherwise stated.

  11.2. Prices are subject to change but will be communicated prior to purchase. 11.3. Late payments may result in suspension of services until payment is received.

12. Governing Law & Dispute Resolution

  12.1. These Terms are governed by the laws of the Republic of South Africa.

  12.2. Any disputes shall first be addressed through negotiation. If unresolved, disputes may be referred to the relevant South African consumer protection or legal authorities.

13. Changes to Terms

  13.1. SiteForge may update these Terms at any time.

  13.2. Updated Terms will be posted on the website with a new Effective Date. Continued use of services constitutes acceptance of the updated Terms.
